BuzzBrain Terms & Conditions

These Terms & Conditions (Terms) apply to the BuzzBrain website and BuzzBrain products and services operated by Buzz Business Boosters, a partnership (ABN 88 199 005 173) in New South Wales, Australia.

1. About these Terms

By accessing the BuzzBrain website, creating an account, applying for or participating in a trial, private beta or early-access program, purchasing a subscription or using a BuzzBrain service, you agree to the terms that apply to that service.

If you use BuzzBrain on behalf of a business or organisation, you confirm you are authorised to do so.

2. About BuzzBrain

BuzzBrain provides software, AI-assisted services and business-support tools designed to help businesses manage enquiries, job costing, quoting, follow-up, scheduling, customer communications, reviews, visibility, marketing, administration and related workflows.

Products may include BuzzBrain Reception, BuzzBrain Time Boost, BuzzBrain Reviews, BuzzBrain Visibility, BuzzBrain Social, BuzzBrain HQ, Free Tools and other services introduced by BuzzBrain.

Products and features may have different statuses, including Available now, Private beta, Early access and On the Roadmap. A Roadmap item is not a representation that it is currently available.

3. Business use and age

BuzzBrain is primarily designed for business use. Account holders and users entering into a subscription or service arrangement must be at least 18 years old.

You are responsible for ensuring a service is appropriate for your business and for the way you use it.

4. Accounts and authorised users

Where an account is required, you must provide accurate information and keep it reasonably current. You are responsible for maintaining the confidentiality/security of login credentials and for activity through your account.

Contact us promptly if you believe an account or authorised device has been accessed without permission.

5. Acceptable use

You must not use BuzzBrain for unlawful, fraudulent, misleading, abusive or infringing activity; to transmit malicious software; to interfere with systems; to gain unauthorised access; to unlawfully collect/process information; to impersonate another person/business; or to deliberately disrupt or overload a service except where applicable law expressly permits otherwise.

6. Your information and content

You retain ownership of business information and content you provide, subject to third-party rights. You give BuzzBrain a limited permission to host, process, transmit and use that content to the extent reasonably required to provide, secure, support and maintain the service and requested integrations/onboarding.

You are responsible for ensuring you have the right to provide and use content submitted to BuzzBrain.

7. AI-assisted features

Some BuzzBrain services use artificial intelligence, automation or third-party AI technology. These systems can make mistakes.

AI-generated information, calculations, suggestions, summaries, transcriptions or extracted information should be reviewed where appropriate before significant business decisions are made.

BuzzBrain does not replace professional legal, accounting, taxation, financial, engineering, safety or other regulated professional advice.

8. BuzzBrain Time Boost

BuzzBrain Time Boost is a business/job-costing, quoting, follow-up and scheduling product. It can help configure costs and charge-outs, estimate true job cost, calculate/review recommended quote prices, create/share quotes, follow up quotes, schedule jobs, record actual performance, manage vehicle/fuel/trip/expense information, process supported documents and use other enabled functions.

Time Boost does the maths and organises information; the business owner makes the final decision.

9. Costing, quoting and business calculations

Calculations depend on user-entered data, imported setup data, supplier information, estimates, routing information, configured margins/charge-outs and other settings.

Some costs may be confirmed, estimated or unknown/needing confirmation. You remain responsible for checking inputs and deciding final customer pricing.

Time Boost does not guarantee profitability, quote acceptance, supplier prices, future costs, tax outcomes, travel times or accuracy where inputs are incomplete or incorrect.

10. Customer-facing quotes

You are responsible for reviewing customer-facing quotes before sending them, including customer details, scope, price, GST treatment, terms and other information.

BuzzBrain is not responsible for a pricing or scope error that results solely from incorrect/incomplete information supplied by the user or from a failure to review information clearly presented for confirmation, subject to rights that cannot lawfully be excluded.

11. Routing, maps and locations

Routes, distances, travel estimates and location information may be derived from third-party services and may be incomplete, delayed or inaccurate.

You remain responsible for safe route selection, vehicle suitability, legal road/access restrictions, directions and site access.

12. Weather

Time Boost may provide job-aware weather information. Forecasts can change and may be incomplete, delayed or inaccurate.

Weather information assists review only. BuzzBrain does not determine whether a job/site is safe, automatically cancel work or automatically reschedule jobs. You remain responsible for weather assessment, worksite safety and whether work should proceed.

13. Customer communications

Current Time Boost Call, Text and Email actions may open the user's device Phone, Messages or Mail application rather than silently sending communications.

Where automated or semi-automated communications are later introduced, the relevant feature will describe how it operates. You remain responsible for ensuring communications comply with applicable privacy, spam, telemarketing and consumer laws.

14. BuzzBrain Reception

BuzzBrain Reception uses third-party telecommunications, voice-AI and related providers to receive/respond to calls on behalf of participating businesses.

Reception may process caller details, enquiry requirements, urgency, call logs, transcripts, summaries, metadata and recordings where recording is enabled. Where recording is enabled, applicable notice, consent and legal requirements must be followed.

Reception is not an emergency service and does not guarantee every call will be answered successfully, every caller will provide accurate information, every transcription will be error-free or every enquiry will become a customer.

15. BuzzBrain Reviews

BuzzBrain Reviews is intended to help businesses request genuine customer feedback consistently.

You must not use it to create fake reviews, impersonate customers, purchase/manufacture reviews, use prohibited incentives, mislead through review gating, or otherwise manipulate a review platform contrary to its rules or law.

BuzzBrain does not guarantee review volume, positive reviews, star ratings, search rankings, AI recommendations, leads or sales.

16. BuzzBrain Visibility

BuzzBrain Visibility may provide information, analysis or recommendations about how a business appears online or locally. Search engines, directories, mapping services, review platforms and AI-powered discovery systems are controlled by third parties.

BuzzBrain does not guarantee a particular ranking, search position, inclusion in AI/search results, recommendation, enquiry or commercial outcome.

17. BuzzBrain Social

BuzzBrain Social may assist with content planning, creation, approval, scheduling, publishing or related activities according to the package/features available at the time.

You are responsible for ensuring supplied information is accurate and that you have permission to use supplied photographs, logos, testimonials, customer information and other material.

BuzzBrain does not guarantee reach, engagement, follower growth, search rankings, AI recommendations, enquiries or sales.

18. BuzzBrain HQ and Roadmap features

BuzzBrain HQ and other Roadmap items may describe future direction or planned functionality. Roadmap material is not a promise of a particular launch date or that every concept will be released exactly as described.

BuzzBrain will not deliberately represent Roadmap functionality as currently available.

19. Free Tools and calculators

BuzzBrain may provide free calculators, questionnaires, assessments or tools. Results may be estimates based on user inputs and stated assumptions.

Free Tools do not constitute accounting, tax, financial, legal or professional pricing advice and do not guarantee business performance.

20. Service providers and data handling

BuzzBrain uses third-party technology, infrastructure and service providers for functions such as cloud hosting/storage, authentication, telecommunications/voice services, AI/automated processing, document extraction, mapping/routing, calendar integrations, weather, payment processing, email/messaging, app distribution, analytics and security.

Third-party services may have their own terms, privacy policies, availability and technical limitations. BuzzBrain does not control every aspect of third-party services, subject always to rights/remedies that cannot lawfully be excluded.

21. Third-party integrations

If you choose to connect a supported third-party account/service, you authorise the exchange of information reasonably required for that integration. You are responsible for maintaining any required third-party account and the third party's own terms/privacy practices also apply.

An integration may stop working if the third party changes or withdraws its service, permissions, API or functionality.

22. Google services

Time Boost may use Google Cloud Platform, Google Maps Platform, Google Calendar/OAuth and Google Cloud Document AI. Routes, place information and automated document extraction can be incomplete or inaccurate and should be reviewed.

Google Calendar integration is optional. If connected, Time Boost may create/update scheduled-job events and access information reasonably necessary for calendar functionality.

23. Weather information

Time Boost may provide job-aware weather information using third-party weather services. Forecasts can change and may be incomplete, delayed or inaccurate.

Time Boost does not determine whether a job/site is safe, whether regulatory/workplace requirements are satisfied, or whether work should be cancelled/postponed. The user remains responsible for those decisions.

24. Routes, distances and travel estimates

Any route, distance, travel-time or location information is an estimate derived from available information and third-party services. Actual conditions may differ because of traffic, road closures, access restrictions, vehicle restrictions, weather, route changes or inaccurate addresses.

Use your own judgement when planning travel, quoting transport or deciding whether a route/site is suitable.

25. Artificial intelligence and automated processing

Automated technologies assist practical business tasks but do not replace owner judgement. Outputs may contain errors and important information should be reviewed.

BuzzBrain does not provide accounting, tax, legal, financial, engineering, workplace-safety or other regulated professional advice through automated features.

26. BuzzBrain Reception - caller information

Reception may process caller name, telephone number, address/suburb, reason for calling, service requirements, urgency, answers to configured questions and other voluntarily supplied information.

Depending on configuration, call information may include call logs, transcripts, summaries, metadata and recordings where enabled. Recording requires compliance with applicable notice, consent and legal requirements.

27. Customer communications

You remain responsible for communications you choose to send. You must not use BuzzBrain to send unlawful, deceptive, abusive or unsolicited communications.

Where applicable, you are responsible for compliance with the Spam Act 2003 (Cth), privacy laws, consumer laws, telemarketing rules and consent requirements.

28. Reviews and review requests

You must not use BuzzBrain Reviews for fake reviews, impersonation, prohibited incentives, misleading review gating or other manipulation contrary to platform rules or law.

BuzzBrain does not guarantee a particular number of reviews, positive reviews, star rating, rankings, AI recommendations, leads or sales.

29. Visibility, search and AI discovery

Search engines, mapping services, directories, review platforms and AI-powered discovery systems are controlled by third parties. BuzzBrain cannot guarantee a particular ranking, search position, inclusion, AI recommendation, enquiries, sales or commercial outcome.

30. Social media services

BuzzBrain Social functionality may vary according to the package available at the time. You remain responsible for approvals where approval is part of the service and for rights to supplied material.

Third-party social platforms may change algorithms, features, APIs, policies or availability.

31. Beta and early-access services

Private beta, beta testing, early access, preview or experimental functionality may change, improve, be replaced/removed, contain defects or experience interruptions.

You should not rely on beta/early-access functionality as your sole recordkeeping or backup system. Nothing in this section excludes rights/guarantees that cannot lawfully be excluded.

32. Time Boost private beta and founding offer

Time Boost may be offered free of subscription charges during private beta. Any founding discount, free launch period or other promotion will be described when offered.

Before any paid Time Boost subscription begins, the applicable subscription price and billing terms will be disclosed. You will not be charged merely because you participated in a free beta without appropriate notice and authorisation.

Where an ongoing discount is expressly linked to continuous subscription, it may end if the subscription is cancelled or allowed to lapse.

33. Assisted setup and onboarding

BuzzBrain may offer assisted setup/onboarding. If you choose it, you authorise BuzzBrain to use information you provide for that purpose.

Where cloud workspace access is required, BuzzBrain intends to use customer-authorised, scoped access rather than unrestricted standing access. You remain responsible for reviewing the resulting setup and confirming your business information, costs, prices and settings.

34. Business Setup files

Time Boost Business Setup files may contain commercially sensitive information such as business information, ABN, labour/vehicle/machinery costs, supplier relationships, purchase prices, charge-out rates, margins, locations/coordinates and a logo.

You are responsible for deciding who you share a Business Setup file with. Only share it with someone you trust.

35. Crew and authorised users

Future functionality may allow owners/admins to give authorised users access to parts of a workspace. Access may vary by role.

The account owner/admin is responsible for choosing authorised users, assigning appropriate access, removing access when no longer required and keeping account/device access secure.

36. Intellectual property

BuzzBrain/Buzz Business Boosters owns or licenses the intellectual property in the BuzzBrain website, products, software, interfaces, designs, branding, logos, original content and proprietary workflows. Third-party software/services/content remain owned by their respective owners.

Subject to these Terms, you receive a limited, non-exclusive, non-transferable right to use the Services for internal business purposes during authorised access.

37. Your content

You retain ownership of business information, customer information, documents, images, logos and other content you provide, subject to third-party rights.

You grant BuzzBrain a limited licence to host, process, reproduce, transmit and technically modify content only to the extent reasonably required to provide/support the Services, operate integrations, maintain security or comply with law.

38. Confidential and commercially sensitive information

BuzzBrain products may process internal costs, margins, supplier prices, customer pricing, quotes, job profitability, locations and business processes. BuzzBrain will take reasonable measures appropriate to the Services to protect information under its control.

You are responsible for protecting sensitive information when exporting, downloading, sharing or granting access.

39. Security

BuzzBrain uses reasonable technical and organisational measures appropriate to the Services, which may include encrypted connections, cloud-provider controls, authentication, access controls, workspace separation, secure secret storage, audit logging and device/session controls.

No electronic system can be guaranteed completely secure. You are responsible for credentials, devices and authorised access.

40. Availability and maintenance

BuzzBrain aims to provide reliable Services but does not guarantee uninterrupted/error-free operation. Services may be affected by maintenance, updates, internet/telecommunications failures, third-party interruptions, infrastructure incidents, security events, device/OS changes or circumstances outside reasonable control.

Where reasonably practical, BuzzBrain will work to restore affected Services. Statutory rights remain unaffected.

41. Changes to products and features

BuzzBrain may improve, modify, add or discontinue features. We will not deliberately misrepresent Roadmap functionality as currently available.

Where a change materially reduces core functionality of a paid Product, we will take reasonable steps to notify affected customers. Applicable legal rights remain unaffected.

42. Pricing changes

Current pricing is displayed on the relevant BuzzBrain page or communicated before purchase. BuzzBrain may change subscription prices from time to time.

For an existing recurring paid subscription, we intend to provide at least 30 days' notice before a price increase takes effect unless you expressly agree otherwise, the change results from a tax/government charge, or a shorter lawful period is reasonably necessary in circumstances outside our control.

A price increase will generally apply from a future billing period. You may cancel before the new price takes effect.

43. Cancellation

Unless different terms are disclosed before purchase, recurring BuzzBrain subscriptions are month-to-month. You may cancel before your next renewal.

After cancellation, no further renewal will be charged after the cancellation takes effect and you generally retain access until the end of the billing period already paid for. Access then ends unless another arrangement applies.

Where export functionality exists, export information you wish to retain before access ends. Retention/deletion is governed by the Privacy Policy and applicable law.

44. Suspension and termination

BuzzBrain may suspend/terminate access where reasonably necessary, including for unpaid fees, serious/repeated misuse, material breach, security risk, unlawful use or where continued provision is not reasonably possible.

Where appropriate and lawful, we will provide reasonable notice and an opportunity to remedy before terminating a paid account. Immediate action may be taken for serious security, fraud, unlawful conduct or harm.

45. Data export and account closure

Where supported, BuzzBrain may provide tools or reasonable processes for exporting business information. Arrange any required export before access ends.

As Time Boost cloud functionality develops, account-management features may include exporting data, deleting a business/account, revoking devices/sessions and revoking BuzzBrain onboarding/support access.

46. Disclaimers

To the extent permitted by law, BuzzBrain provides practical business tools/services, not professional advice; calculations/recommendations depend on available information; third-party information may be incomplete/inaccurate; automated outputs may contain errors; and commercial outcomes depend on factors outside BuzzBrain's control.

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

47. Australian Consumer Law

Our Services come with rights and guarantees that may apply under the Australian Consumer Law and other applicable legislation. Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right, remedy or protection that cannot lawfully be excluded, restricted or modified.

Where the Australian Consumer Law permits liability for failure to comply with a consumer guarantee to be limited, BuzzBrain's liability may, where fair and reasonable, be limited to remedies permitted by law, such as supplying the Services again or paying the reasonable cost of having them supplied again.

Nothing in these Terms limits any right to a refund, cancellation, compensation or other remedy where that right cannot lawfully be limited.

48. Liability

To the maximum extent permitted by law, BuzzBrain and Buzz Business Boosters are not liable for indirect, incidental, special or consequential loss where such liability may lawfully be excluded, including loss arising from incorrect/incomplete user information, unreviewed estimates or automated extraction, or third-party failures outside reasonable control.

This section does not apply where liability cannot lawfully be excluded/limited, arises from non-excludable rights, or results from conduct for which exclusion would be unlawful. BuzzBrain does not seek to exclude responsibility for fraud, wilful misconduct or other liability that cannot legally be excluded.

49. No guarantee of business outcomes

BuzzBrain does not guarantee increased revenue/profit, more customers/jobs, quote acceptance, reduced costs, rankings, reviews, ratings, social growth, AI recommendations, productivity savings or any other particular commercial outcome.

Examples, calculators, estimates, statistics, case studies and illustrations explain concepts and potential impacts and are not guarantees of individual results.

50. Information and research

BuzzBrain may publish research findings, industry statistics, benchmarks, examples and educational information. Where third-party research/statistics are used, BuzzBrain aims to identify or attribute the source where appropriate.

Research may relate to a particular surveyed population and period and may not represent every business/customer. Consider your own circumstances when making business decisions.

51. Free Tools and calculators

Free calculators, questionnaires, assessments and tools provide general practical information based on entered information and assumptions. Results may be estimates.

Free Tools do not constitute accounting, tax, financial, legal or professional pricing advice or guarantee business performance.

52. Links to other websites and services

The BuzzBrain website may link to third-party websites, applications, platforms or services. A link does not necessarily mean BuzzBrain endorses, controls or guarantees the third party.

Third-party websites/services are governed by their own terms and privacy practices.

53. Feedback and product suggestions

If you voluntarily provide feedback, BuzzBrain may use it to improve products, functionality, documentation, onboarding or support and understand customer needs.

You retain ownership of pre-existing intellectual property in supplied material. Feedback does not give BuzzBrain ownership of your business/customer data. Unless separately agreed, providing an idea does not require BuzzBrain to implement it, compensate you for it or treat the general idea itself as confidential.

54. Confidentiality

Where either party receives non-public confidential information from the other in connection with the Services, it should be used only for the purpose for which it was provided and protected with reasonable care.

This does not apply to information lawfully public, already known without restriction, independently developed, lawfully obtained elsewhere, or required to be disclosed by law. Where lawful and reasonably practical, the receiving party should notify the other before legally required disclosure.

55. Privacy

BuzzBrain handles personal information in accordance with the BuzzBrain Privacy Policy and applicable privacy laws. The Privacy Policy explains information collection/use, device/cloud storage, providers, integrations, document processing, overseas processing, security, retention, access/correction and privacy enquiries/complaints.

56. Changes to these Terms

BuzzBrain may update these Terms to reflect product/service changes, technology/providers, business practices, legal/regulatory requirements, security requirements or clarification.

The current version will be published with a Last updated date. Where a change materially affects an existing paid customer's rights/obligations, BuzzBrain will take reasonable steps to provide advance notice where required or appropriate. Changes will not retrospectively remove accrued rights.

57. Notices and communications

BuzzBrain may provide notices through email, in-product/account notification, the website or another contact method associated with the account. You are responsible for keeping relevant business contact information current.

Legal/contractual notices to BuzzBrain may be submitted through the contact method specified on the website or another method we provide.

58. Electronic communications

You agree that communications relating to your use of BuzzBrain may be provided electronically where permitted by law, including account, service, subscription, billing, security and product notices.

Marketing communications are subject to applicable consent/unsubscribe requirements. Operational or transactional messages may still be sent where reasonably necessary to provide/administer the Service.

59. Assignment and business changes

You may not transfer a subscription/account to another person/business without BuzzBrain's consent except where the relevant Product allows it.

Buzz Business Boosters may assign/transfer rights or obligations as part of a legitimate restructure, sale, merger, transfer of the BuzzBrain business/assets or succession arrangement, provided doing so does not unlawfully reduce your rights.

60. Severability

If any provision is invalid, unlawful or unenforceable, it will be interpreted or limited to the minimum extent necessary where legally possible, or severed if it cannot be preserved. Remaining provisions continue to operate to the extent permitted by law.

61. Waiver

If BuzzBrain does not immediately enforce a right, that does not mean the right has been waived. A waiver of one breach does not automatically waive another breach.

62. Entire agreement

These Terms, together with applicable order/subscription details, specific Product terms presented before purchase, the BuzzBrain Privacy Policy and other expressly agreed terms form the agreement governing the relevant Services.

Where specific written Product/subscription terms conflict with these general Terms, the more specific terms apply to the extent of the inconsistency, subject to applicable law.

63. Governing law

These Terms are governed by the laws of New South Wales, Australia and applicable Commonwealth laws of Australia.

The parties submit to courts and tribunals having jurisdiction in New South Wales, subject to any rights a person has to bring a matter elsewhere under applicable law.

64. Resolving concerns

If you have a concern about a BuzzBrain Product or Service, please contact us first so we can understand and address the issue. We aim to deal with concerns reasonably and in good faith.

Nothing prevents you from exercising a right to contact a regulator, consumer-protection body, tribunal, court or other authority.

66. Effective date

These Terms & Conditions are effective from 26 September 2026.
